Neovot is currently in a closed testing phase. By participating in testing, you acknowledge that the Service is under development and may contain bugs, errors, or limitations.

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the Neovot mobile application and related services (collectively, the "Service"), operated by Neovot ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Testing Phase and Limited Availability

Neovot is currently in a closed testing phase. Access to the Service is limited to individuals who have joined our waitlist and received an invitation to participate in testing.

During the testing phase:

  • The Service is provided "as is" and may contain bugs, errors, or interruptions
  • Features and functionality may change without notice
  • We may suspend or terminate the Service at any time
  • Data may be lost or corrupted; we recommend keeping backup records of critical health information
  • We may request your feedback and suggestions for improvement

3. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration and Security

To use the Service, you must create an account by providing accurate, complete, and current information. You agree to:

  • Maintain the confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Update your account information to keep it accurate and current
  • Be responsible for all activities that occur under your account
  • Not share your account with others or allow others to use your credentials

5. Permitted Use

The Service is designed to help you track and manage health information for yourself or your elderly relatives. You may use the Service only for lawful purposes and in accordance with these Terms.

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of Neovot or third parties
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated tools (bots, scrapers) to access the Service

6. Medical Disclaimer

IMPORTANT: Neovot is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.

  • The Service is a tool for tracking and organizing health information to share with healthcare professionals
  • It is not a substitute for professional medical advice, diagnosis, or treatment
  • Always seek the advice of qualified healthcare providers with any questions regarding medical conditions
  • Never disregard professional medical advice or delay seeking it because of information provided by the Service
  • If you think you may have a medical emergency, call emergency services immediately
  • We do not verify the accuracy of any health information you enter into the Service

7. Consent to Process Health Data

By using the Service, you explicitly consent to the collection and processing of your health information, which is classified as special personal data under Ghana's Data Protection Act, 2012 (Act 843).

You acknowledge and agree that:

  • You have read and understood our Privacy Policy
  • You freely and voluntarily provide consent to process your health data
  • You may withdraw consent at any time by deleting your account
  • If you are tracking health information for a family member, you have obtained their explicit consent

8. Data Ownership and Export

You retain ownership of all health data and personal information you input into the Service. Neovot does not claim ownership of your data.

You have the right to export your data at any time, delete your account and data, and request copies of your data from us.

9. Intellectual Property Rights

The Service, including its design, features, software, trademarks, logos, and content (excluding user-generated content), is owned by Neovot and protected by intellectual property laws of Ghana and international treaties.

10. Payment and Fees

During the testing phase, the Service is provided free of charge to invited participants. We reserve the right to introduce subscription fees when the Service becomes publicly available.

11. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

We may suspend or terminate your access to the Service immediately if you violate these Terms, engage in fraudulent activities, or pose a security risk.

12. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Neovot shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Medical decisions or outcomes based on information in the Service
  • Service interruptions, errors, or data loss during the testing phase
  • Unauthorized access to or alteration of your data

13. Indemnification

You agree to indemnify and hold harmless Neovot from any claims, liabilities, damages, losses, or expenses arising from your use or misuse of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

14. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes shall be resolved through good faith negotiation, followed by mediation if necessary, and finally subject to the exclusive jurisdiction of the courts of Ghana.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the app. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Neovot regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Force Majeure

Neovot shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
